End User License Agreement

NOTICE TO END USER: PLEASE READ THIS END USER LICENSE AGREEMENT (“EULA”) CAREFULLY BEFORE ACCESSING OR USING MYSTORYBOOKLET.COM (THE “WEBSITE”) AND ANY MATERIALS OFFERED OR PROVIDED THROUGH THE WEBSITE. THIS EULA GOVERNS ALL USE OR ACCESS TO THE WEBSITE AND ANY MATERIALS AVAILABLE THROUGH THE WEBSITE AND FORMS A LEGALLY BINDING AGREEMENT BETWEEN THE SIGNFICANCE PROJECT, A MINISTRY AND D/B/A OF CRU® (CAMPUS CRUSADE FOR CHRIST INC.) (“TSP”) AND YOU, THE END USER OF THE PLATFORM.

BY CLICKING “I AGREE” THE END USER ACKNOWLEDGES THAT END USER HAS READ AND UNDERSTANDS THIS EULA AND THAT END USER IS BOUND BY THE TERMS AND CONDITIONS OF THIS EULA. IF END USER DOES NOT AGREE TO ALL OF THE TERMS AND CONDITIONS OF THIS EULA, THEN END USER IS NOT AUTHORIZED TO ACCESS OR USE THE PLATFORM AND END USER SHALL IMMEDIATELY CEASE ACCESSING AND USING THE PLATFORM.

1. PLEASE CAREFULLY REVIEW THE TERMS OF USE OF THE WEBSITE. The Website is owned and operated by TSP, a ministry of Cru, a California religious nonprofit corporation, for the purpose and services of providing materials for the furtherance of its mission to connect people to Jesus Christ. The use of the Website is governed by the Terms of Use (“TOU”) as well as this Agreement. As your use of the Website will indicate your acceptance of the terms of the TOU and this Agreement, do not use the Website if you do not agree to be bound by these terms. The TOU are available to review on the Website, and we may periodically change the TOU. Please check the TOU from time to time as your continued use of the Website signifies your acceptance of any changed items.
2. LIMITED LICENSE. Your use of the materials included on the Website, the Gospel presentation publications entitled Can God Meet the Longing of Your Heart and Can You Know God Personally (“Licensed Materials”), is for non-commercial, personal ministry purposes only consistent with the mission of TSP. For clarity, commercial use is any attempt to make money from the Licensed Materials such as selling them for a price. TSP grants you a non-exclusive, non- transferable, revocable permission and license to do the following with the Licensed Materials:
   1. add to the section indicated in the Licensed Materials your own personal testimony of how you put your trust in Jesus Christ as the provision of God for the forgiveness of your sin and as the way to know God personally and experience his love and purpose for your life (“Your Story”);
   2. download, print and distribute at no charge to the recipients copies of written Licensed Materials in their entirety, provided that the Licensed Materials have not been edited or modified by you in any way or form other than to add Your Story to the section indicated in the Licensed Materials and in alignment with the Guidelines below; and
   3. download, post and display in electronic format at no charge to recipients the Licensed Materials in their entirety on your personal or ministry social media account or via email for non-commercial ministry purposes, provided that the Licensed Materials have not been edited or modified by you in any way or form other than to add Your Story to the section indicated in the Licensed Materials and in alignment with the Guidelines below.
3. LICENSE RESTRICTIONS. You are prohibited from using the Licensed Materials beyond the scope of the limited license granted in this Agreement. You agree that you are responsible for using the Licensed Materials only as authorized in this Agreement, and that you will not change, edit, adapt or modify the Licensed Materials in any way or combine the Licensed Materials with any other work, either made by you or a third party (except to add Your Story to the section indicated in the Licensed Materials); or sell the Licensed Materials or make any other commercial use of the Licensed Materials (the Licensed Materials must be distributed to the public without any charge, license fee, subscription fee or any other access fee).
4. COPYRIGHT AND TRADEMARK, RESERVATION OF RIGHTS. Unless otherwise noted, all materials, including the Licensed Materials, on the Website are protected as the copyrights, trademarks, service marks and/or other intellectual properties owned or controlled by TSP. All rights not expressly granted are reserved. You shall maintain all copyright notices, trademarks, and other credits and attribution supplied in, on, or with the Licensed Materials and will include such in all display or exhibition of the Licensed Materials including such changes as directed by TSP from time to time. While you retain your rights to Your Story, you acknowledge and agree that your use of the Licensed Materials under this Agreement does not transfer to you any commercial or promotional use rights in the Licensed Materials or any ownership in the Licensed Materials. TSP has the right to change, suspend, remove, disable, or impose access restrictions or limits to the Licensed Materials at any time without notice or liability.
5. GUIDELINES FOR ADDING YOUR STORY. When adding Your Story to the sections indicated in the Licensed Materials, please ensure that the content you add honors the following guidelines:
   1. Your expression of Your Story should align with the Biblical message and mission of the Gospel of Jesus Christ as expressed in the Licensed Materials, and Your Story must be yours and not the story of someone other than you.
   2. Your Story as expressed in the Licensed Material should be careful not to include information that:
      1. is the copyright, trademark or other type of intellectual property that is owned or controlled by someone other than you;
      2. is the personally identifiable information of someone other than you;
      3. is for the purpose of promoting any message other than the Gospel of Jesus Christ
      4. is false, defamatory, obscene, vulgar, indecent, promotes violent or illegal activity or is otherwise not in alignment with the Biblical instruction to speak the truth in love and to honor and build up one another in the faith.
6. DISCLAIMER OF WARRANTIES; LIABILITY LIMITATION

   TSP DISCLAIMS ALL WARRANTIES ABOUT USING THE WEBSITE OR USING THE LICENSED MATERIALS TO THE FULLEST EXTENT PERMITTED BY LAW. TSP DOES NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE WEBSITE OR LICENSED MATERIALS WILL BE UNINTERRUPTED OR ERROR-FREE, AND YOU AGREE THAT FROM TIME TO TIME TSP MAY REMOVE ACCESS OR LICENSED MATERIALS FOR INDEFINITE PERIODS OF TIME, OR TERMINATE THE WEBSITE AT ANY TIME WITHOUT NOTICE TO YOU. THE LICENSED MATERIALS ARE PROVIDED “AS IS” AND

   THE LICENSED MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE” FOR YOUR USE, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT. TSP DISCLAIMS ALL WARRANTIES TO THE FULLEST EXTENT PERMITTED BY LAW.

   IN NO CASE SHALL TSP OR ITS RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF ANY OF THE SERVICES OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE WEBSITE OR LICENSED MATERIALS, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, TSP’S LIABILITY SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW.

   TSP SHALL USE REASONABLE EFFORTS TO PROTECT INFORMATION SUBMITTED BY YOU IN CONNECTION WITH USING THE LICENSED MATERIALS, BUT YOU AGREE THAT YOUR SUBMISSION OF SUCH INFORMATION IS AT YOUR SOLE RISK, AND TSP HEREBY DISCLAIMS ANY AND ALL LIABILITY TO YOU FOR ANY LOSS OR LIABILITY RELATING TO SUCH INFORMATION IN ANY WAY.

   TSP DOES NOT REPRESENT OR GUARANTEE THAT USE OF THE WEBSITE OR THE LICENSED MATERIALS WILL BE FREE FROM LOSS, CORRUPTION, ATTACK, VIRUSES, INTERFERENCE, HACKING, OR OTHER SECURITY INTRUSIONS, AND TSP DISCLAIMS ANY LIABILITY RELATING THERETO.

7. TERMINATION. This Agreement is effective until terminated by you or TSP. TSP may terminate this Agreement immediately by any form of notice to you or by revoking your access to the Licensed Materials or the Website. Upon termination, you may no longer access and use any materials on the Website, and you may no longer use the Licensed Materials as permitted under the license grant in this Agreement.
8. GENERAL TERMS. This Agreement is binding upon the Parties hereto, their heirs, successors, and personal representatives and may not be assigned without TSP’s approval. This Agreement constitutes the entire understanding among the Parties. Its terms can be modified only by a written instrument signed by TSP. A waiver or a breach of any of the provisions of this Agreement is not a continuing waiver of other breaches of the same or other provisions hereof. This Agreement is governed by the laws of the State of Florida. The Parties consent to exclusive jurisdiction and venue in the courts of the state of Florida and the federal courts in the US District Court for the Middle District of the State of Florida.
